HYPE.HK Terms of Service

1. Welcome

By using HYPE.HK ("we", "our", "us"), you agree to these Terms. If you don't agree, please don't use our service. We may update these Terms; we'll notify you of material changes via email or through the platform.

2. What We Do

HYPE provides a mapping platform for institutions and individuals to host projects and share location-based information. Users can contribute places, images, feedback, and other content ("User Content").

3. Your Account

  • You must provide accurate information when creating an account
  • Keep your password secure. You're responsible for activity on your account
  • We can suspend or terminate accounts for violations of these Terms

4. Your Content

What you own: You retain rights to content you upload.

What you give us: By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute your content on HYPE for the purpose of operating and promoting the service. This license ends when you delete your content or account, except where others have already shared or embedded it.

Your promises: You confirm that:

  • You own the content or have permission to share it
  • Your content doesn't violate others' privacy, intellectual property, or rights
  • Your content is lawful under Hong Kong law (no defamation, hate speech, or illegal activity)

Moderation: We may remove content that violates these Terms or that we deem inappropriate, without notice.

5. Acceptable Use

Don't use HYPE to:

  • Upload malware, spam, or misleading information
  • Harass, stalk, or harm others
  • Scrape our data or interfere with our systems
  • Violate any applicable laws (including Hong Kong's Personal Data Privacy Ordinance)

6. Intellectual Property

  • Our IP: HYPE's software, branding, and platform design belong to us. You receive a limited license to use the service.
  • Your IP: You retain rights to your original content as stated in Section 4.

7. Disclaimers (The "Legal Cover" Section)

Service "As Is": We provide HYPE on an "as is" and "as available" basis. We don't guarantee the service will be uninterrupted, error-free, or that content is accurate.

Map Data: Location data and user contributions may be inaccurate. Don't use HYPE for critical navigation or emergency services.

Third-Party Content: We're not responsible for content uploaded by other users or third parties.

8. Liability Limitation

To the extent permitted by Hong Kong law (specifically the Unfair Contract Terms Ordinance, Cap. 459):

  • We aren't liable for indirect, incidental, or consequential damages (lost profits, data loss, etc.)
  • Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim, or HK$1,000 (whichever is higher)
  • What we can't exclude: Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or anything else that cannot legally be excluded under Hong Kong law

9. Indemnification

You agree to indemnify us against claims arising from your use of HYPE, your content, or your violation of these Terms.

10. Termination

You can delete your account anytime. We can suspend or terminate your access for violations of these Terms or for operational reasons. Sections 4, 6, 7, 8, 9, and 11 survive termination.

11. General

  • Governing Law: These Terms are governed by the laws of the Hong Kong Special Administrative Region.
  • Disputes: Any disputes will be resolved in the courts of Hong Kong.
  • Severability: If any part of these Terms is unenforceable, the rest remains valid.
  • Assignment: We can assign these Terms to a successor. You cannot without our consent.
